Article 16
1. Where a Member State has justifiable reasons to consider that a
product which has been properly notified and has received written
consent under this Directive constitutes a risk to human health or
the environment, it may provisionally restrict or prohibit the use
and/or sale of that product on its territory. It shall immediately
inform the Commission and the other Member States of such action
and give reasons for its decision.
2. A decision shall be taken on the matter within three months in
accordance with the procedure laid down in
article 21.
