Part C notifications approved under Directive 90/220/EEC

A number of transgenic crops have been authorised in the EU under Directive 90/220/EEC which entered into force in October 1991 (see table). Since Directive 90/220/EC was the first legislation covering GMOs, consents were given under this legal framework for all types of uses of transgenic plants, namely cultivation, import and processing into feed and/or food products (for more explanation: see placing transgenic plants on the market).

Authorisations were granted for the cultivation of ten carnation lines (4, 11, 15, 16, 66, 959A, 988A, 1226A, 1351A and 1400A) as cut flowers; the production of seeds of three chicory lines RM3-3, RM3-4, RM3-6, tobacco line ITB1000OX and hybrid oilseed rape MS1xRF1; the cultivation of maize lines Bt176, MON810 and T25; import and processing of maize MON810, maize T25 kernels and oilseed rape Topas 19/2 for feed purposes and import; and processing of maize Bt176 and GTS 40-3-2 soybeans for food en feed purposes.

The notifications submitted under Directive 90/220/EEC and the pending notifications had to be renewed under the new Directive 2001/18/EC repealing Directive 90/220/EEC since 17 October 2002 in order to avoid disparities between consents granted under that Directive and those pursuant to the new Directive and in order to take full account of the conditions of consent under Directive 2001/18/EC.

*Explanatory notes to the table

  • Column 1 of the table refers to the European identification number for the application given by the rapporteur Member State. This number is composed as follows: C-for part C-/Member State initials/year of introduction /national code.
  • MS Consent (column 7) refers to the written consent given by the rapporteur Member State (MS) indicating that the product can be placed on the EU market if no further objections are raised by the other Member States (e.g. carnations dossiers).
  • In column 6, links are made to the opinions of the Scientific Committee on Plants (SCP) of the Commission (http://europa.eu.int/comm/food/fs/sc/scp/outcome_gmo_en.html).
  • The state of play of the different notifications is indicated in column 7, with crosslinking to the Commission Decisions. Dates of MS consents are also given. EC decisions pursuant to Council Directive 90/220/EEC are published in the Official Journal. A list is available on this server.
  • Generally, consents are given for the described transformant and all progeny thereof obtained by traditional crosses with other (non-genetically modified) varieties. In addition to the approval under Directive 90/220/EEC, transgenic plant lines have to be registered (at national level) as plant variety before any commercial cultivation is allowed.
  • In column 8 the status of the transgenic crop lines on other world markets is indicated: in many cases, products still in the European pipeline have already been authorised for marketing elsewhere. This column contains cross links to the US and Canadian decision documents from the USDA Animal and Plant Health Inspection Service (APHIS) (http://www.aphis.usda.gov/biotech/not_reg.html) and Plant Biotechnology Office of the Canadian Food Inspection Service (http://www.inspection.gc.ca/english/index/pppve.shtml).
